Who is Legally Responsible?

Accidents generally happen due to someone’s negligence. The less-careful party is considered “negligent”, and thus must pay for at leas some of the damages sustained by the victim. This is how liability is determined.

Comparative negligence occurs when the injured party was also careless. In this case, their compensation may be reduced by the extent such carelessness caused the accident.

If the guilty party was driving a company vehicle on company time at the time of the accident, the employer may be liable. Companies like delivery services are prime examples.

More than one person can be at fault, however. If more than one party is responsible for your injuries, one person may be fiscally responsible for covering your claim.
